You'll likely not get a 6950 because the value of a 5870 has dropped and they would offer you a product that's valued at about the same as a used 5870 (yours). It seems unfair but this is how they do it here in the UK too. You should tell them that you paid for a high-end enthusiast product and that you don't want a mid range card.

You should ask for a 6950 1GB but they'll likely not give it. Just say the minimum you want is a 6870 and no less (they are about 5% slower than a 5870 and you can sell it and get something else if you want). If they refuse just report them to your country's business/trading organization or whatever.

Don't give in!

The distributor can only offer what they have.

They don't have any 5870's so they offer what they feel is a fair swap, And given the market value of a used 5870 a new 6850 is a fair swap.

If they give you a 6950 then they'll lose money.

If you want another 5870 or a 6950 then send it to the vendor as they will more then likely have another 5870/6950 to replace it with.

We could argue as much as you guys want, but in Spain the law forces the store/retailer to provide SAME performance or better, but never worse, like prava has said a few times.

They can offer an exchange on a per-price basis which can and does result in slower products being offered.

Consumer law in Spain is based on a EU agreed law that all countries in the EU have to follow.

At the end of the day he broke the card.

Claiming the card should handle extreme burn mode is stupid as it's known by any decent hardware enthusiast that it causes cards to crap out.

HE broke the card and he's complains when the retailer don't want to foot the bill?

lol opinions are overrated. Doesn't matter what your opinion is, what matters is what the warranty says.

He already said that he never overclocked it and as long as he never tampered with it the card legally should be able to handle anything he puts his computer through.

Offering a 6850 for a 5870 is a slap in the face.

OP please remember that you water cooled the card, Did you change the TIM?

If they've stripped the card down and noticed that the stock TIM has been replaced they could also toss and just fail the RMA.

People in Europe get shafted when it comes to stuff like that.
