Yea but on the listing he said the board was still under waranty so ive just emaild him to ask him how i can get it changed. Or can i do this without having to contact him?

Send it back. If the seller refuses to accept a return for it, file a Paypal dispute.

Gigabyte should be able to fix that for you at a cost. But try repairing your self. RMA is still an option.

Yeah there are most def 4 pins that are bent. I have spent hours trying to get a CPU to sit right which is why I HATE those damn pins. Why cant intel just put the pins on the CPU like AMD does that would solve this problem all together!

I would hate to have a 980x with pga. Break one pin off and its over. Motherboard companies might pity you and will repair at a cost.

There's a good chance it still might work properly. I have a giga board that has bent pins on it. I tried straightening them out as best as I could, but it's still noticeable. I put the chip in and it works like a charm. I also had a ud3r that the pins were ruined. I sent it to gigabyte to fix and they replaced the socket free of charge. I ended up having to rma the board 2 more times to get a working one, but they still fixed the socket for free and I only had to pay shipping once.

Ive just contacted gigabyte so fingers crossed they will repair it or send me out a new board.
