Yes it is illegal to sell them without Intel's permission but that doesn't mean people don't sell ES chips.

And 1.6GHz sounds about right for early ES chips. ES chips are rarely ever near the eventual stock clocks that the retail chips ship with. They are more or less for testing out the architecture and trying to find ways to make things more efficient in newer revisions. They aren't trying to break OC world records or anything like that.

So just because its 1.6GHz doesn't mean its fake. In fact, it probably is a real chip.
