I'm pretty sure the agreement is to protect the research. If they gave out 1000 of these things to people who were just going to sell them on ebay, then you end up with 1000 people who are now basing their opinion of it on how much they paid, not just it's usage. I doubt it has anything to do with "fairness".
More importantly, agreement or no agreement, selling something he got for free doesn't make him an ass, which is what was being implied. He is under no moral obligation whatsoever to give it away to someone else if he doesn't want it anymore.Edited by Manyak - 4/17/11 at 6:14am
