T-Mobile billing me 6 years later

OK, back in 2004 i had t-mobile. My phones were temporarily disconnected due to me not being able to pay my bill. I called t-mobile up and asked what my past due balance was that i needed to pay to get my phones turned back on. they explained it was $3XX.XX. Said, ok, gave em a credit card number and they explained it would be 1-2 hours till my phones were reconnected. OK, no big deal. 3 hours later i call them up and ask why my phones are not on and they explain that i have a $400 charge(2 X $200 per line cancellation fee). They canceled my lines and charged me the cancelation fee after my account was paid in full and suppose to be re-connected. I just found out they are still trying to collect...now through a collection agency for the $400. How the hell can they do this crap? my account was paid in full BEFORE the account was closed and before the charges($400) was added to my account.

LOL tmobile customer support keeps telling me i canceled my account. What BS

There is a four year statue of limitations on such debts. Don't let them tell you it is 4 years from the time they bought the debt. Tell them to sue you to get the money and not to call you as you consider that harassment. Good luck.

Hmm, I work for T-Mobile customer care and that sounds weird. I do know however that if an account goes under suspension for non payment for more than 3 months it automatically gets cancelled out and a collection agency takes over. If from what you are saying is true and your phones have been shut off since 2004 then damn they have been canceled for some time now. BUT if you are talking about that they were recently canceled out(within the past 2 months) then there should be no reason that they had got canceled out. The main thing that happens is that when people can't pay the bill they think the account will just sit there till they feel like paying the amount off and it'll automatically be reconnected. Nope. Unfortunately it isn't, wish I could say that it was but what should have happened is when you initially called in letting them know you couldn't make the payment(if you did), then the representative should've let you know you only have 3(4 months tops) to get it paid off unless you had some type of payment arrangement setup to stop that from happening. Like the guy above me said, good luck, but that is a losing battle you're fighting right there hate to tell you it but just based on the story you told right there, it's not looking in your favor.

The next time you speak with the debt collector, tell them you are giving them "an official cease and desist order, and per the FDCPA they can NOT contact you any longer." Remind them that if they violate this cease and desist order, you will sue them. I bet you $$ they hang up on you. I've done this a few times before when a debt collector tries to collect on a debt I've already paid.

No offense to anyone here at OCN who works in collections (I know it's a nasty job) but most debt collectors are pure SCUM. They lie and cheat, and I hope that they all (except the few who are polite and actually helpful) burn in hell for all eternity.

But even if he does that(since he didn't already pay it, he only paid his past due amount not the ETF for the lines being canceled), wouldn't it just sit on his credit then and hurt it?

exactly the problem now. They said they have been trying to collect since 2005 so the statute of limitations does not apply here. Funny thing was my account was only suspended for 2 weeks when i finally paid the past due. Just to re-iterate, when i paid my past due, there was a $0 balance. Even Tmobile agrees with this. the problem is i paid early in the morning, before 6am and the cancellation fees were already on there but didn't show on balance until after 9am pacific or something like that. Every person at Tmobile i speak to(even supervisor) is friggin impossible to understand(accent) and tells me to contact the collection agency.

Contact them and REQUEST PROOF that this is indeed a debt you owe still. They will have 30 days to respond to your written notice. If they do not respond in a timely manner, you are allowed to write to all 3 credit companies (Equifax, Experian, and the one that stars with a "T"... sorry, brain fart) and request that any reference to this particular debt be removed from your record.

Include a copy of the correspondence you sent the credit company, along with the tracking # and delivery signature confirmation as proof they received it and failed to send you anything in return and your credit score will no longer be harmed by this mess.

Also, since Tmobile agrees that at the time you paid, there was a $0 balance due, it might help your case to have them send you something stating that in writing. And if you can't understand someone's accent, I believe you have the right to request to speak with someone from the USA, provided you are being polite and professional. I could be wrong on that tho.
