I don't think the situation is that black and white. For both parties mind you, it would cost a lot to both companies if Samsung backed out.

Apple isn't the only company that sues its competitors. Companies have been suing their competitors since the dawn of the time. In recent years Japanese electronics companies have sued their Korean competitors on numerous occasions. When LG entered the US appliance market Whirlpool was quick to sue LG.

Apple and Samsung have signed numerous contracts and I doubt they would be willing to break them. Apple relies heavily on Samsung components from the processors, nand, ram, and lcds. Actually everyone relies on Samsung components. Samsung controls around 40% of the nand, ram,and lcd market. By far they are the largest manufacturer in these components.

To protect patent and trademarks and establish a precedent.

Samsung and Apple have contracts probably years ahead for their components that Apple needs and Samsung will supply them. Apple made 3.9B payment to secure display supplies last quarter. (That is probably divided between sharp, samsung and lg..etc)
