[BBC] Google fined $5m over Linux patent row

Seriously bad news, i don't get how companies can patent part of the Linux kernel, it's under the GPL!

I think they can patent part of the Linux kernel they create because they don't want something that's open source to be used to make a profit. The law suit is likely because somebody created a part of the kernel, as an open source piece of code, and intended for it to stay open. Not used in software for means of profit.

So is Texas going to take the $5 million and give it back to the people that Google profited off of? I mean since they weren't supposed to profit off of it that would be the right thing to do...

EDIT: for the record I'm not rolling my eyes at you jcf1, I'm rolling them at a dumb lawsuit that's going to do nothing but line pockets of lawyers.

What's wrong with using open source code for profit? Just because it is open source does not mean it can't be used for profit, that just means it is available to everyone.

I find it dumb that a patent could even be made over open source code protected by the GPL license considering that means 3 things:

1. You are free to distribute it
2. You are free to modify it
3. You are free to sell it

So why would you be able to patent it and then sue? I think this is more of an issue with the patent offices letting stupid things through, which they seem to do a lot. Considering a judge sided with the patent offices' decision though, they are just continuing the cycle...
