I don't really get how DHL can get sued for mechanical failure ?

Seems like a pointless lawsuit, I bet they will lose.

MS should sue them. It's utter bs that we need to buy additional insurance when something is shipped. The shipping company should insure the stuff for up to a certain amount. I hope MS wins this suit.

And if DHL had to reimburse damages for EVERYTHING, including non-insured packages, they would have to step up their game and actually give a s*** on how they handle the packages.

Pretty sure when you ship with DHT, UPS, Fedex you sign a paper, on that paper it says you can't sue for loss packages.. which is why you have to buy insurance seperately.

They signed the paper, they have no chance in court.

So were was I when this happened... I woulda ninjaed right in and got a few hundred

Also I hope my 2 SD cards I ordered arnt on a train, I just got an email about shipping confirmation and its through these guys! I didnt insure them either >.< lol

I don't know for sure, but I suspect DHL probably cut a deal to get M$ft's business and it probably included insurance. Otherwise, why would M$ft sue them if they were clearly going to lose? It sure isn't because they need the money.

I assume since they were on their way to China, they were probably warranty returns...ninjas don't typically snatch broken hardware.
