little things like that add a lot to a site, and while things like that don't make a case, it says that he lacked the attention to detail to worry about the customer, its not hard to connect the dots that he also lacked the interest in seeing if his actions were legal.. rather HIS CLIENT had to go out of his way, causing him lost time and money to find out information that he should not even need to think about. I assume the vendor was paid for a complete website, IMO its not a complete product if CC can potentially come after you

Yeah, the site is really crappy. I noticed that right from the beginning. It was paid in full already (a very large sum of money). I dont know the programmer. But Im working with the company to make them a short term site since they need the advertising.

That sucks.
Here is the current plan:
1. Threaten to report him to CC. Make him refund 100% of the cost.
2. Report him to CC even if he pays.
3. Code new website.

When I undertake website development I often show the client a mock up of the site made with publisher, or frontpage. This gives them a rough idea of how the site will look and function. If your friends aren't happy with the site that has been developed then they should by all means request that the developer change the website accordingly. If possible they should explain how they want the site to function.

With regards to their attempt at trying to avoid paying the developer for the work undertaken just because a template was taken under Creative Commons, that's just outright lame. Creative Commons is not the same as full copyright and the developer is perfectly fine using a template as it is their time for developing the site that they are being paid for, not the template! If the developer was selling the template code directly online then he would be in breach of the lisence, but they aren't in this case.

Find a good lawyer. There's always a way to screw someone who does work this badly.

Chances are that this company isn't the first one he's done it with either, so if you can find some history on him you may get even more leverage.
