And don't forget to pull down copies of the html from the server and get screen shots and whatnot... it takes about 30 seconds to correct one of his major flaws

(I feel like I'm stalking this thread... I should get out more on the weekends)

lol. I already did something better. I used the took a video of the screen as I went though the site and open up the source code and looked though it.

On a side note, you say 'Open Source' - if you meant GPL licensed (which you don't in this context, but just to say) - then it is perfectly legal to sell GPL licensed code. Of course, you have to give them a reason why they should buy it from you and not go to the project and get it for free.

In this circumstance, it's noncommercial CC, which is a complete no-go.

Creative Commons is not the same as Open Sourcing. CC is about retaining rights, while giving other rights. Open Source (via the GPL) is about giving permission to distribute. (You can take GPL code and do whatever you want with it (modify it, use it) - whether you agree to the license or not, but you can't distribute it (or any modifications) unless you follow the GPL - note selling is allowed by the GPL).

I haven't been following the thread, but it seems to me that as long as you keep the buyer informed that the template is actually open source and thus he doesn't own rights for it, you're fine. And of course, the template's license needs to be abided to by the new user (ie he can't sell the template, and he probably has to keep a link to it's license on the website).

You sold your site, which means you sold all the work you put into your website as a whole. Legally speaking, you did not sell your template (because you can't).

Actually, read my post, it's not open source, and if it was, then it would be completely legal to sell it.
