Is it legal to use open source templates for a site and then sell the site?

A friend of the family has a business. A guy made a site for him. He used a template. I was able to link to this from what was in the code. What can you tell me about this site: http://hiwasseeangler.com/contact.html

Note: Im not promoting it. The guy they hired only did a part way job and they trying to go after him. They need some leverage.

I don't think shareware has an agreement.
But that agreement you just linked to says that you can't use it for commercial purposes, meaning sell it.
Also, that site is under the license, so you can't use that template for commercial purposes.

It doesn't matter if a website was used with a Creative Commons protected template. The developer charges for their time in planning, designing and codeing the site. If part of that code includes parts of someone elses work that has been freely released it doesn't matter.

Sorry to hear of the misfortune. Chipp is right, the designer shouldn't have been using the markup for the purposes of 'professional' web design.

That being said, the owners taking this design, and filling in the blanks themselves *may* come in violation as well, since its promoting a business venture (don't know if its in their plans, but something to think about nonetheless)

When you're looking for a web guy, always be sure to ask how he/she is creatively, and ask to see a portfolio with unique examples.. you can spot boilerplate from original stuff.

Looks like a real nice place though!

Ok thanks for the help everyone. Im taking the site offline in a little bit. I copied all the source code to use against him.
Before I take it down, take a look to see if there is anything else they can use for leverage other than copying the template.

I should note: This company hired a guy to do it. They will be asking for a refund or follow though with some legal action.

IMO, the site wasn't done well either.

Is there a reason he used a "wunderground" weather feed?

I'd point a lot to how unprofessional the work in question is.. (go from the home page to another section and the background changes (not a problem) and is tiled incorrectly (problem)

little things like that add a lot to a site, and while things like that don't make a case, it says that he lacked the attention to detail to worry about the customer, its not hard to connect the dots that he also lacked the interest in seeing if his actions were legal.. rather HIS CLIENT had to go out of his way, causing him lost time and money to find out information that he should not even need to think about. I assume the vendor was paid for a complete website, IMO its not a complete product if CC can potentially come after you
