Default My brawl with Dell to get Windows Vista refunded

My brawl will Dell to get Windows Vista refunded!!!

I ordered an e1705 (with a go 7900gs)
and want to get Vista refunded because i want to run xp on it anyways.

Here was my chat with them and i guess i will have to wait till Monday to call them....

Trust me... you're not going to get a dime!

Just for the heck of it... this would be an estimation of value:
Uograding to Vista Business will cost you $99 at Dell. However, on Newegg, Vista Business OEM sells for $139.99. Thus, the value of the installed Home Premium is about $139.99 - $99 = $40.99

When comparing with Ultimate ($199 for the Dell, and $189.99 OEM on Newegg), we actually get a negative value for the Vista Home Premium installed on the Dell

Dell gets those Vista licenses in such bulk that it doesn't cost them a whole lot (I'd say... if anything). Plus, the fact that it's installed already voids the clause in the EULA, since installing is a form of use.

Again, I don't see you getting money back for it.

Oh, rly???? the EULA does state that (if you decline it, which you can) you get your money back.... Its not like im the first to do this i got the idea from this guy http://www.theinquirer.net/default.aspx?article=35610

and i guess vista is $159.95 off of the windows website...

and retail vista home premium is $219 off newegg

Well, the way I look at it is this: Everyone's time is worth a certain amount of money. Some more, some less. You need to ask yourself whether the value of the amount of time you spend screwing around trying to bully dell into refunding you exceeds the value of the refund you are going to get, and seeing that this is an uphill battle anyways at best case I see you breaking even.

Ok,

You might have a shot getting *some* money back.

Just don't use prices that are listed on MS.. since that's end-user prices, and since you got it from Dell, it'll be a LOT less (since it's bulk in tens of thousands most likely).

They give you Windows for free when you buy a Dell. the only way to get money back is if you upgrade the OS then don't want it.
And as said, don't compare Retail prices, the copy you have is OEM, and like Chozart said, Dell's price for an OS is minimal, way less than OEm price online.

A lot of people have gotten their money back from dell. But all the people who I read about who did it did it from Germany dell or France dell.

Given that information, plus that the link he OP referred to is in the UK, I get a feeling that this might be due to differences in the laws in the EU and the US. IT seems to me that in Europe the law is more in favor with the buyer, while US law likely sides with Dell (otherwise, this would happen much more often).

And yes, do not compare with retail! Those licenses are different. Plus, the OEM license cannot be sold, since it's 'married' to the Dell.

I really don't give you a lot of chance.
