well i hate to be the one that gives the bad news.
you bought a used item.
the item was refurbished and checked out to make sure it works.
well everything on it works, their is nothing wrong with your unit.
xbox live is on the internet, your built in modem works, your unit is identified and by your own words the unit is banned from xbox live.

it really seams odd to me to ban the unit and not the name because
i remember readding about gamer tags being banned for 999 years and that the amount on banned time was some kind of a joke.
like already stated xbox does ban units that show up as being modded or not to factory specs.

Threaten legal action and you will get what you want and maybe more if you play your cards right. Im not saying take them for all they are worth, Im saying that you should get what you deserve for this ridiculous activity on their part.

The previous owner had flashed the dvd drive and was banned from xboxlive so he proably took that to gamestop and got himself a new one.

If it's still firmware modded, sell the console on eBay. Don't specifically mention the firmware modding, but do give them a clue about it. Also state it'll be banned on Live. You'll most likely get almost what you paid for it back.

I'm sorry, but I fail to see why him having bought a used console from Gamestop means it's fair for him to have a banned console.

Gamestop is not allowed to take in a console that has a broken or tampered warranty seal. The only way he could have been banned by Microsoft from Xbox Live is either by a random fault on their part (call 1-800-4MY-XBOX), or if the DVD firmware was modified. As of current, there are zero modchips or softmods out there.. Nor are there any HDD exploits. My point is: The warranty seal had to be broken to modify the DVD firmware, as that's the only way to get it done-- The console must be opened.

To the original poster: If Gamestop does not make things right despite how they screwed you over, call the Xbox 1-800 number and explain your situation to them and how Gamestop won't do anything to make things right. It's possible that the ban was a mistake on Microsoft's part. They can unban consoles if you're truly innocent.

If you can manage to get unbanned, and the warranty seal isn't intact.. I would try to restore the firmware to stock state. There is absolutely no reason why you should need a modified firmware-- Spoofing because of a dead drive is just an excuse. There are more legitimate ways of repairing a faulty drive.

Firmware modifications do not allow for homebrew.. Aside from spoofing (which only a small percentage of modded FW users do), the primary purpose of modified firmware is to make a 1:1 copy of a game bootable (the firmware ignores the media flag, telling the system that burnt discs are okay to launch). Therefore, the act of flashing with a modified firmware is primarily for piracy reasons.. Which is not acceptable by OCN's ToS.

..And before anyone says it, don't even try to tell me people use it to play only backups of what they own. That is hardly ever the case.

QFT. Gamestop is at fault in selling a console that was banned to begin with.

That's BS what that they sell BANNED Xbox's. You'd think they'd take the time to make sure it worked.

I usually stay away from Gamestop. They're nothing but a shaft up your arse anyway!

I agree that gamestop should give you another unit. Let the store manager do his thing, make sure you check back with him periodically, and if he says that nothing can be done, call corporate. Or as someone else suggested get the district managers phone #, and if he does nothing or fails to take your call, call the corporate office. Something will get done, and itll make the regional manager look like an ass for not being able to handle a simple customer service issue.

Meh, you'll have a much better time talking to Gamestop (I know thats scary), Microsoft support is usually in India. My dad had to tell them that I died in a car accident to cancel our Xbox Live.

see if microsoft will send you a record of when the console was banned, then atleast you would have proof that you were sold a defective console.
