NO. They do ban gamertags. Gamertag bans are when people constantly cheat or do other things online such as send pictures of certain things, and stand bye They ban consoles when people hack them! Such as flash the DVD drive's firmware and play illegal games, like people were playing gears of war 2 a week before its release.

I am a manager at a retail store that buys used xbox's. We DO NOT check internet functionality. All I do, is turn it on, put a game in, and play it for 5 or so minutes. That being said, there are very specific rules to what you can return, and how much time you had to do so. Your situation serves as a warning to anyone on here that may buy a used one in the future. You need to check everything out right away. Now, if it were my store, I would have just taken it back right away, because a happy customer is a spending customer

Let me get this straight. If you mod an XBox physically or otherwise, you can get banned from online play?

Why? Don't people do this with PC's every day? Don't they have PC's vs. XBoxes on some games?

What's the big deal?

well this is a truely bad situation because its your word against Microsoft on weather or not they banned you or the previous owner, in your case your right but i mean how many people could scam them by saying this.

do you still have your receipt from gamestop?? if so, fax them or scan the receipt to them and show them that you did in fact buy this xbox from gamestop, and it will show the date you purchased, since you did not get banned during your use the ban date in the microsoft system should be before your date of purchase, in theory microsoft should back down and re-enable your system.

I hope this helps for ya i would hate to be in your shoes

Microsoft will have NO simpothy for you because no company supports selling and buying used stuff, because by you buying a used 360 you basically said SCREW YOU MICROSOFT IM GIVING MY CASH TO GAMESTOP, because with used purchases Microsoft gets NO MONEY

Best advice so far. Their 30-day warranty should cover any defects at the time they sold it to you until the end of 30 days. If you can prove that the defect existed either before they sold it to you or within those 30 days, the date that you discovered the problem should be irrelevant.

This is precisely why I would never buy a used car. I can't imagine going through the headache you're having now, only having to shell out the cost of an XBox 360 every month for the next several years.

First of all, thanks guys. I've read a lot of solid advice here. It's nice to hear some folks have my back and support my position regarding this situation. Sure, I probably should have checked the console to see if it was banned, but hind sight is 20/20. Lesson learned. When I'm sold an item that is refurbished however, although I do take that risk that perhaps the unit might be faulty physically after a certain warranty period, I find it a safe and reasonable assumption that the manufacturer would allow the unit to utilize all of it's services. Even a warning of taking some sort of risk would have been acceptable and would have prompted me to check immediately.

Well, I generally disagree with that statement. Microsoft makes the majority of their money on game sales and peripherals. If I have a fully functional XBox I will most certainly purchase plenty of games and fancy accessories. Not to mention I'd be paying for their XBox live service as well. That's a good chunk of money in M$'s pocket. Also, if someone sold their console, they obviously were not interested in purchasing any new games any time soon. The new owner obviously is however. It really is a good situation for Microsoft to have an XBox owner regardless of what route they purchased their console.

Super Big Props go out to battlenut for suggesting that I contact the folks that run "Watchdog" with Maximum PC. I could definitely use a good consumer advocacy group and they seem like exactly what I might need to resort to if Game Stop ends up being unreasonable.

It's kind of sad really. I would like to use this product and purchase products and service to use with this product. Through no fault of my own, I am not able to contribute to sales to Microsoft. Ironic isn't it?

Hopefully I will hear from the manager I spoke with at Game Stop by Monday. If I don't, I will contact his supervisor immediately and proceed to go up the ladder until I find someone that will help me out. If that doesn't happen, I'll put as much pressure on them with consumer advocacy groups, bad publicity and general annoyance as I can.

I'd like to think I could find a solution with Microsoft, but it took 3 hours and 6 different "Service Representatives" before I could even find one single competent individual. They weren't able to help, and once I spoke to their supervisor, all they offered me was "Sorry... can't do anything about that."

I made the poor choice to purchase this unit with cash and not hold onto the receipt longer than the warranty period. I wait tables at nights, so often I have cash to burn in my pocket. Next time, I'll make sure the transaction is fully recorded with my bank and the receipt will never leave my sight. I might have it somewhere though, but regardless, that's really a minor issue in the whole scheme of things.

Again, thanks OCN. This forum community has always been a great knowledge base that I've been able to learn from.

I'll keep you all updated on what happens!!
