I've had a similar problem, but with a second hand ps2 disc.

I bought a preowned copy of GTA:SA from eb games.

I tried the disc in 3 different ps2's and none of them worked.

I took it back the next day. The guys like "I'm sorry i can't take this back."

So i asked to speak to his manager. I ordered a new copy, and what i paid on the preowned went onto the new copy.

But all this second faults is a load of crap. They should check everything before approving for sale.

Correct, and if I remember correctly, Microsoft technically loses money with each new console sold.. Which is where the accessories, games and XBLM merch pick up.

Gamestop is not allowed to take in a console that has a broken or tampered warranty seal. If you can manage to get unbanned, and the warranty seal isn't intact.. I would try to restore the firmware to stock state. There is absolutely no reason why you should need a modified firmware-- Spoofing because of a dead drive is just an excuse. There are more legitimate ways of repairing a faulty drive.

Firmware modifications do not allow for homebrew.. Aside from spoofing (which only a small percentage of modded FW users do), the primary purpose of modified firmware is to make a 1:1 copy of a game bootable (the firmware ignores the media flag, telling the system that burnt discs are okay to launch). Therefore, the act of flashing with a modified firmware is primarily for piracy reasons.. Which is not acceptable by OCN's ToS.

..And before anyone says it, don't even try to tell me people use it to play only backups of what they own. That is hardly ever the case.
Four pages and everybody in this thread concludes that the previous owner flashed the firm wire? Why just let me ask why does it have to be the firm wire? More than likely some kid got a hold of someones credit card make some purchases on xbox live the card holder look at the bill and was like " W.T.F MATE?" Call his credit card company they returned his money canceled the card and said it was stolen thus Microsoft was had to return money to the credit card company or was notified of the situation and heres the tricky part THEY BANNED THE CONSOLE!!!

As someone already stated try to see if Microsoft will can send you some sort of information on when the console was banned. But you do have to realize that you bought a used product and there are risks with used products. To be honest if i was gamestop i dont think i would take the xbox back, i believe on the box the xbox comes in there are warnings and stuff too.

I got an argument for that. The XBOX 360 is sold including XBOX Live as part of it's feature set. The boxes even say it comes with a free membership. If the unit is permanently banned, he has not received a fully functional product as described by the packaging. The fact that a unit can get banned is not even presented until you read the EULA which wouldn't occur until after you've already purchased the product.

But... it was after 30 days so your SOL anyways.

Nope. No such warnings at all. If there was anything at all that mentioned, "This product might not have all the features advertised. Purchase at your own risk." I would NOT be upset in this situation. It advertised a fully functional product. This unit is not.

I believe this is an issue of disclosure. Finding out if this console is banned is as simple as cross referencing the serial number. If a company goes through so much trouble to ensure the hardware is fully functional why do they skip such a simple yet very important step?

There was no mention of any risk that the product might not work as advertised. I feel it's a combination of laziness and apathy on Game Stop's part.

wow.. that sucks xbox live does too.. if u really want to play l4d you should buy it on steam for 25 bucks while you can.. i believe it's still at that price i'm not sure

They'd probably respond that its the buyer's responsibility to check everything to make sure there is nothing wrong and that a 30-day window of opportunity is something they have to enforce in order to prevent the possibility that the problem is not a defect, but damage caused while it was in your posession blah blah blah console blah blah broken blah blah not our fault blah blah blah...

If I was you i'd trade it right back in for another one, eat the hundred bucks or so you'll end up getting screwed out of in th end and chalk it up to a lesson learned.

I still say if you havent gotten any positive response you should threaten legal action or even talk to a lawyer for real. Even if you dont have the money, a lawyer may help you for a bit of the settlement if it goes that far. Worse thing that would happen is they say they want X amount and you find another lawyer to talk to. Not all of them are *******s. ;0

Can you check with microsoft to see when the console was banned? If you can prove that it was banned before you purchased the console then that sure be enough proof that they sold you a defective machine, and that you are entitled to a replacement.

I was out of town today, but I got back last night. I'm happy to say that today I've got some good news.

JJ, the manager from Game Stop called me and told me to come in with my console. I brought it in with all the original peripherals and packaging. When I was there he got on the phone with his district manager while I was there. He explained the whole situation very fairly and accurately. After a brief consideration, the DM said "I really suggest that you decline an exchange since there's no way we can verify if the console was actually faulty before we sold it and he never returned the console within the 30 day limit." After a little back and forth banter, the call ended and JJ looked a little dismayed and I was very upset.

JJ looked at me and said... "You know what... I can't in good concience screw you over. Let's get you changed out." He took my console, gave me another refurbished one, and asked me to call him immediately if there are any issues.

I took it home and everything's been great. Left 4 Dead has been taking up all my time today. I just wanted to give a shoutout to JJ at Game Stop in Roseville, CA. He really went out on a limb for me and helped me out. I'll definitely be patronizing that store from now on and I'll be writing a letter to compliment him to the corporate office.

Thanks for all the advice guys, I'm glad it was a happy ending.
