Does it come with HT disabled and a notice saying: "Activate HyperThreading at your own risk"?

Depends entirely if it's truly a binned CPU or just a higher clocked CPU. If it's a higher bin and can do 5.0 all core at the same default VID as a vanilla 9900K then it might be a good CPU. If it's just a 9900K with a voltage bump and set to all-core 5.0 then yeah, it's stupid.

Intel i9 9900K Coffee Lake @ X8 5309mhz (+47.5%)
AMD FX-8320 Vishera @ X4 5022mhz (+43.5%)
Intel i5 4690K Haswell @ X4 5013mhz (+43.2%)
AMD X4 960T Zosma @ X6 4870mhz (+62.3%)
Intel i7 6700 Skylake @ X4 4709mhz (+38.5%)
Intel i5 6400 Skylake @ X4 4588mhz (+69.9%)

they're like going through the same damage control AMD did with Vishera, although Intel's chip isn't as bad.

And this is the crux, because if you disable hyperthreading, which is the FIX for a lot of these security exploits. It will get owned by Ryzen 2 and we all know that.

Yep Exactly! How tables turned (my forst PC was A64 3000+ s939) :-).

And what's the point in this CPU if we can get this:

Bios update could of done this it seems just changing default from by core usage to all core.
Not every chip can do 5ghz at stock volt. So most likely those are binned chips under the best manufacturing process they can run, running at stock volts (or close).
So you can't just get it through bios update.

I’m sure it runs hot and after owning my overclocked 7700k for years I’m not looking for another hot cpu if possible.
