I imagine if the court were to proffer technical advice about what Microsoft could do to hinder user info data-mining on LinkedIn, they might suggest that Microsoft could increase the visibility of cautions to their users about protecting their own data. Something along the lines of:

CAUTION: DATA-MINING RISK, HELP PROTECT YOUR PERSONAL INFO. ONLY ALLOW THOSE YOU KNOW TO SEE YOUR FULL PROFILE.

They could then provide a link that describes how to do so.

Fortunately, courts typically don't proffer such mundane stuff.

Oh my such a damn problem to throttle abusive users, every online service should have that protection in place where a super human can't click and load the data fast like that but an automated script/program can.

There are and will always be ways to circumvent these types of protection, headless browsers.. running multiple slower scraping tools from different IPs etc.
The only sure fire way to put a stop to it is to not expose the data publicly....

tbh public availability of data is the problem, has nothing to do with people scrapping them, e.g. the moment they posted their data for all to see is where the problem begins.
should always opt for some privacy measures and only expose the bare minimum information you can tolerate other people seeing.

pen names exists for a reason.
