I imagine if the court were to proffer technical advice about what Microsoft could do to hinder user info data-mining on LinkedIn, they might suggest that Microsoft could increase the visibility of cautions to their users about protecting their own data. Something along the lines of:
CAUTION: DATA-MINING RISK, HELP PROTECT YOUR PERSONAL INFO. ONLY ALLOW THOSE YOU KNOW TO SEE YOUR FULL PROFILE.
They could then provide a link that describes how to do so.
Fortunately, courts typically don't proffer such mundane stuff.
