Exploding iPod touch sets kid's pants on fire, melts his underwear, causes untold emotional pain

An Ohio mom is filing a lawsuit against Apple on behalf of her son, whose "iTouch" popped in his pocket and proceeded to torch his pants. He had to be treated for second degree burns on his leg, had a hole burnt through his pants pocket and got an underwear melting to top it all off. Also, according to the lawsuit, "He continues to suffer from both physical and mental conditions which will cause him to suffer pain, mental distress, emotional distress, and otherwise for the rest of his life." Poor kid! In addition to Apple, the lawsuit seemingly randomly names 10 Apple retail employees, and wants $150,000+ and attorney fees in damages. While we've seen a couple burnt charging cables of late, this is the first we've heard of an iPod touch "popping," and it's especially odd because the lawsuit claims the iPod was turned off at the time of the incident. Whether or not that's true, we'll be certainly keeping an eye on a trend developing here. When it comes to our children, burning pants are everyone's business.

Are these things ever really off? As far as I know, EVERYTHING is only ever on standby, or some sort of standby mode unless you remove the power source.

yes ipod touches can be turned off its just nobody does it lol (you just hold down the top button then a slider says slide to turn off)

but back to topic doesn't the touch have a lithium cell battery and from my knowledge when a cell in battery rupture theirs fire, very hot fire.

PSPs are on standby even if they have no battery in


They have some weak internal battery. If you pull out the battery and set it to Hold, the LED still lights up.

some part of me KNOWS that this kid was doing something else like setting off fireworks with his friends but doesnt want his mom to know so he told her that bogus story. now its just going to far out of his control.

Oh what a load of absolute crap. I hope they lose and have to pay their own as well as Apple's legal fees. I'm sorry for the kid, but people that try to sue for absolutely ridiculous crap like that need to get shafted.

if my ipod touch exploded in my pants, i'd sue too. :S

and it's not like they're charging all that much. 150k is chump change compared to the usual damages in these kind of suits. it's waaaay under a million.

I'm not sure what you guys are on, but considering the ipod CAUGHT FIRE in his pocket i would have to say Apple is liable.

This isn't some stupid law suit where a kid shot himself in the face with a 22 rifle and the parents filed a lawsuit because the gun didn't have some sort of fool-proof anti-child lock built into the handle. The ipod battery exploded, and Apple is fully responsible for that.
Though the whole BS statement about the emotional distress could have been left out, i applaud the family for only suing for 150k instead of 7 million or something ridiculous as that seems to be the trend lately.
