It later turned out that Samsung accidentally leaked their exFAT source code. The solution has now been corrected with Samsung formally open-sourcing their exFAT source code.

good news, exFat makes up for the limitations of Fat32 4gb file size limit going into the future. Should mean exFat and h.265 support on bluray players going forth.

Also I believe NTFS isn't open source and exFat is basically the open source solution to that file system when it comes down to it.
