How does this break anything since the game is open beta, its like saying people posting screen shots of windows 7 build 7000 is against TOS.

It has always been that way. Just because you can sign up doesn't mean it is open beta. If you are indeed in the beta: take a look at the main page (middle right). The game is still closed beta and posting screenshots from the game is against the NDA.
