I sent in my processor 3 weeks ago. i got a call saying we recieved it, but the heatsink wasnt included, we must have it to replace your processor. I called the tech support guy (princeton) and told him, hes trying to find a work around.

Since THEY have it, and 5 days pass, wouldnt that mean that they keep it and dont return it to me? if so am i screwed?

Well, its your fault, you shouldve known that if youre gonna RMA a product you better have ALL the ins back in the box to send back, otherwise theyre not gonna replace anything.

how would i know? i dont have the box, i dont have the heatsink, and i dont have the manual, all that stuff was chucked. i threw the heatsink out the day i got the processor, had a different one. it i bit me in the ass.

yeah im screwed now... my mobo is comming back this week, and ill have MOST of my parts back. (except ram and gpu, those were in the garbage at the lan)

Using a 3rd party heatsink voids the warranty, so I'll be interested to see what happens from here.

here what you should do you reply claiming you rang up and were told NOT to return any of the above (that you chucked) and the fact it was not included in the return was NOT you fault as the person who you spoke told you not to,this will put the ball in their court,if they say well it makes no difference the items weren't in the return you say you want to speak to a manager/head of department and say the above and if they don't apoloizge to you and say we'll send a replacement you just sayu'll be contacting say citizens advice bureau (thats what its called in uk )about the matter and state the fact u'll mention that they'll be keeping your property...failing that you screw (what every they say keep it sharp and varge and be polite but NOT apologetic ) good luck
and hope this helps you

edit: option to would be to claim taht you return all items and they must have misplaced them but this would be harder to pull off as they've already said you didn't return the items so be careful not to put yourself in a postion where they could get you for false information

Well, they can't legally keep your CPU... that's like theft... but if they don't know they have, that's sort of a different story...
A good lesson here, keep all original parts to something incase you need to return it... I think you need to call your buddy up and ask him what the hell is going on and where your processor is.

if they dont have a record of it, and i sent it in, and give them proof of delivery are they forced to give me a new processor?

if you have proof that your sent it,and they fail to locate it they should have to either refund your loss or give you a new one,unless it wasn't posted where they have to sign for it,then you'd have to claim from the postal service (only if it was insured postage ,then they'll pay out)

yeah, as long as you have proof of shipping and that they recieved it. then you should be fine if for some reason they lost it... but I highly doubt that. the AMD rma department/tech service is quite small. They don't even have employee numbers that they need to give you. you can call and just ask for a person.

Anywho, you should have known to send your cpu in w/ the stock hsf. there is no reason to buy the cpu in a retail box unless you are going to keep that. Also, it clearly states in the warranty info in the manual that you have to send the hsf in too. Furthermore, AMD will tell you to send the hsf in w/ the cpu. I just sent my 3200+ in a few months ago and they specifically told me I had to send the hsf in, and it was in the email they sent me w/ the RMA number. so you really need to pay more attention to things.

i shipped it UPS and it was signed for.

well if AMD says they don't have it... and you just say 'yes, you do' and prove to them that it was signed for... tracking number and all... as long as AMD doesn't remember where it is and/or doesn't bring up that you didn't send your hsf then you should be golden.

if they do remember that you didn't send the hsf they can require you to send it in before they will replace your cpu because they did clearly state that you had to have it to send the cpu in.

It's called the Better Business Bureau in the US.
